§ 1. GENERAL PROVISIONS

Competition entries will be posted on the social media portal Facebook http://www.facebook.com (hereinafter “Facebook Service”) on the page “YONELLE” available by clicking www.facebook.com/KosmetykiYONELLE
1. The contest will start on 9 November 2015 and will conclude on 15 November 2015 at 11:59 PM.
2. Facebook.com is not the organizer or co-organizer of the contest.
§ 2. PARTICIPATION — TERMS AND CONDITIONS
1. Contest is open to all individuals who reached the age of majority.
2. By participating in the Contest, Participants agree to be bound by any Terms and Conditions set out for the Contest.
3. To participate in the Contest, each Participant is to publish the birthday wishes on the occasion of YONELLE’S second birthday and place them under the Contest post throughout the duration of the Contest.
§ 3. CONTEST RULES
1. Each Participant is to create the individual birthday wishes for YONELLE and place it in a comment field under the Contest post. It is expressly forbidden to include any pornographic, politically extreme, offensive or commercial offers that are prohibited by law and universally recognized as morally wrong (controversial).
2. Participants enter the Contest by inserting a comment under the contest post.
3. Under the regulations herein, a Participant who is also the author of the reply, grants the Organizer a license to use the content of the post at YONELLE’S discretion.
4. Winners will be selected out of the published entries by YONELLE PR Department after the closing date of the Contest, namely, up to 10 days after the publication of photos.
5. Information about the results of the contest will be announced on “YONELLE” website and winners will be notified by a message sent to their private Facebook accounts or by placing a comment under the contest photo.
§ 4. PRIZES
1. Prizes consist of YONELLE cosmetics. Two best entries will be awarded a set of Nanodisc Masks (35 ml): Magic Compress Nanodisc Mask No. 1, Youthful Glow Nanodisc Mask No. 2 and Amazingly Smooth Nanodisc Mask No. 3. Moreover, 22 participants will receive a set of 3 sachets (6 ml each) of the products.
2. Prizes are funded by YONELLE beauty concept Zwolińska Chełkowska general partnership (www.yonelle.pl).
3. The value of Prizes awarded in the Contest is considered a taxable income and shall be taxed at a flat rate of 10% of the prize, pursuant to Article 30 Paragraph 1 Item 2 of the Act on income tax on individuals. The Organizer will charge the correct tax amount as part of a lump sum on recorded income, pursuant to Article 30 Paragraph 1 Item 2 of the Act on income tax on individuals of July 26, 1991. Said tax amount will be deducted by the Organizer of the additional cash prize and will equal 10% of the gross prize and paid to the relevant Tax Office. Prizes will be handed as provided in the acceptance protocol.
4. In order for the organizer to release the prize, the winner of the Contest, within 7 days of receipt of the news about winning, must send a reply message including his/her name, address, e-mail and telephone.
5. The prize will be sent to the address indicated by the winner within 14 business days of receipt of the winner providing the full contact details.
6. The Organizer bears the costs of delivery of prizes awarded in the Contest. Prizes can be delivered only in Poland.
§ 5. COMPLAINTS
1. Contest Participants may submit complaints about the Contest within 7 days of the occurrence of the offense. Users should send a private message containing the complaint to YONELLE portal on Facebook.com. The subject of the message should include the following password: “CONTEST-RELATED COMPLAINTS” Complaints should include:
1. Unambiguous data, allowing to identify the Participant.
2. A clearly defined subject of the complaint including the reason for its submission.
3. The exact date of the event (day-month-year)
4. Complaints will be reviewed on an ongoing basis within up to 14 days after filing the complaint. However, the Organizer reserves the right to leave the complaint unanswered if it relates to the dysfunction resulting from ignorance of the Terms and Conditions or User’s failure to follow instructions provided on a regular basis in the pages of the Contest including the Contest photo page.
5. The Organizer’s decision is final.
6. Any Contest-related claims submitted after the deadline specified in the Paragraph 1 will not be considered.
§ 6. FINAL PROVISIONS
1. Organizer hereby declares that the Contest is not a game of chance, Bingo, parimutuel betting, promotional lottery, a game with a random outcome or any other form provided for under the Act of July 29, 1992 on games of chance and bets (Journal of Laws of 2004, No. 4, Item 27 as amended).

2. Personal data of the Contest participants will be used solely for the purposes of the Contest pursuant to Terms and Conditions. Participation in the Contest is tantamount to Participant’s consenting to the processing of personal data for the purpose of the Contest pursuant to the Act of August 29, 1997 on the protection of personal data. Participants are entitled to access and amend their personal data. The provision of personal data by Contest Participants is voluntary.
3. The Organizer shall not be liable for any disruption in the operation of telecommunication links, servers, interfaces, web browsers or Facebook portal.
4. Any disputes that may arise in connection with the Contest shall be settled by the court competent for the registered office of the Organizer.
5. In matters not covered by the Terms and Conditions herein, provisions of the Civil Code shall apply.
The Organizer is entitled to make changes in the Terms and Conditions at any time.
6. The Terms and Conditions herein shall enter into force on the first day of the Contest.
